1. Acceptance of Terms

2. Description of Services

Custom Syracuse Deck & Fence is a licensed contractor providing deck building, fence installation, and related outdoor structure services to residential customers in the Syracuse, NY area. Our services include, but are not limited to:

• Deck repair, replacement, staining, and sealing
• Vinyl, wood, and privacy fence installation
• Pergola and covered structure installation
• Screened-in porches, pool decks, and outdoor kitchens
• Deck railing installation

The specific scope of services for each project is defined in the written estimate and contract provided to the customer before work begins. Services not included in the written scope are not covered by the quoted price.

3. Estimates and Pricing

Written estimates provided by Custom Syracuse Deck & Fence are based on information available at the time of the site assessment and are valid for 30 days from the date of issuance unless otherwise stated. Estimates may be subject to change if:

• Conditions discovered during construction differ materially from those observed during the initial assessment.
• The customer requests changes to the scope, materials, or design after the estimate is accepted.
• Material costs change significantly between the estimate date and material ordering date.

Any changes to the estimated price will be communicated to the customer in writing before additional work proceeds. Verbal estimates are non-binding. Only written, signed contracts constitute a binding agreement.

4. Scheduling and Cancellation

Scheduled work dates are subject to weather conditions, permit timelines, and material availability. Custom Syracuse Deck & Fence will make reasonable efforts to notify you of any scheduling changes as early as possible.

If you need to cancel or reschedule a project:

• Cancellations made before materials are ordered will receive a full refund of any deposit paid, less any permit or design fees already incurred.
• Cancellations made after materials have been ordered may result in forfeiture of the deposit and may require reimbursement for materials already purchased or delivered.
• Cancellations after work has begun will require payment for all work completed to date, plus costs for materials purchased for the project.

Custom Syracuse Deck & Fence reserves the right to cancel or reschedule work due to unsafe conditions, extreme weather, or circumstances outside our control. We will not be liable for delays or cancellations caused by permitting authorities, material suppliers, or acts of nature.

5. Payment Terms

Payment terms are specified in each project contract. Typical payment structure:

• A deposit is due upon signing the contract, as specified in the written agreement.
• Progress payments may be required at agreed milestones for larger projects.
• Final payment is due upon completion and customer walkthrough of the finished work.

Accepted payment methods will be specified in your contract. Payments not received by their due date may incur interest and may result in a work stoppage until the outstanding balance is paid. Custom Syracuse Deck & Fence reserves the right to pursue collection of unpaid amounts, including reasonable legal fees.

6. Permits and Compliance

Custom Syracuse Deck & Fence obtains all required building permits for projects where permits are required under applicable NY state and local codes. Permit fees are the responsibility of the customer and will be itemized in the project estimate. We will not perform work without required permits in place. Permit timelines are outside our control and may affect project start dates.

7. Warranty

Custom Syracuse Deck & Fence warrants that all work will be performed in a professional manner consistent with industry standards and applicable building codes. Specific warranty terms are provided in each project contract.

Our workmanship warranty does not cover:

• Damage caused by improper use, neglect, or lack of recommended maintenance
• Normal wear and tear over time
• Damage caused by extreme weather events, acts of nature, or conditions beyond normal seasonal variation
• Work performed or modified by parties other than Custom Syracuse Deck & Fence

Manufacturer warranties on materials and products are separate from our workmanship warranty. We will assist customers in making warranty claims with manufacturers where applicable.

8. Limitation of Liability

To the fullest extent permitted by law, Custom Syracuse Deck & Fence's total liability to you for any claim arising from or related to our services shall not exceed the total amount you paid us for the specific project giving rise to the claim.

Custom Syracuse Deck & Fence shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of use, lost profits, or damage to personal property not directly caused by our work. This limitation applies regardless of the legal theory under which the claim is brought.

9. Warranty Disclaimers

Except for the express workmanship warranty provided in your project contract, all services are provided "as is" without any additional warranty, express or implied, including implied warranties of merchantability or fitness for a particular purpose, to the fullest extent permitted by applicable law. No verbal statements by our employees or representatives constitute an additional warranty unless confirmed in writing.

10. Customer Responsibilities

To enable us to perform work efficiently and safely, you agree to:

• Provide accurate information about your property and project requirements
• Ensure safe and reasonable access to the work area for our crew and equipment on scheduled work days
• Keep children, pets, and non-essential personnel away from the active work area during construction
• Notify us promptly of any underground utilities, property lines, HOA restrictions, or other conditions that may affect the project
• Make timely decisions on any selections or approvals required to keep the project on schedule
